Terms & Conditions of Sale

Preamble
These general terms and conditions of sale apply to all sales concluded on the OF Course Trader website. www.ofcoursetrader.com is a service of OF Course Trader (individual enterprise), located in France. Email: contact@ofcoursetrader.com OF Course Trader sells the following products: NinjaTrader indicators, automated strategies, and trading courses. Important: The customer declares having read and accepted the general terms and conditions of sale prior to placing their order. Validation of the order therefore constitutes acceptance of the general terms and conditions of sale.
Article 1 — Principles
These general conditions express the entirety of the parties' obligations. The buyer is deemed to accept them without reservation. These general terms and conditions of sale apply to the exclusion of all other conditions. They are accessible on the OF Course Trader website and shall prevail over any other version or contradictory document. The seller reserves the right to modify these general conditions from time to time. They shall be applicable from the moment they are published online.
Article 2 — Content
These general conditions define the rights and obligations of the parties in the context of the online sale of goods offered by the seller to the buyer. These purchases concern the following products: NinjaTrader indicators, automated strategies, and trading courses. Article 3 — Pre-contractual Information
The buyer acknowledges having received, prior to placing their order, clear and comprehensible communication of these general conditions of sale and all the information listed in Article L. 221-5 of the Consumer Code, including: • the essential characteristics of the product • the price • any additional delivery charges • the delivery date or deadline • information on the seller's identity, guarantees, and digital content features
Article 4 — The Order
The buyer may place their order online, from the online catalogue. The sale will be considered final after confirmation by email and receipt of full payment. In certain cases (payment failure, incorrect address, account issues), the seller reserves the right to block the order until the problem is resolved. Article 5 — Electronic Signature
Providing the card number online and final validation of the order constitutes proof of the buyer's agreement: • due and payable amounts under the order form • signature and express acceptance of all transactions carried out In case of fraudulent use of the bank card, contact us immediately at: contact@ofcoursetrader.com
Article 6 — Order Confirmation
The seller provides the buyer with an order confirmation by email.
Article 7 — Proof of Transaction
Computerised records, kept in the seller's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
Article 8 — Product Information
Products are described and presented as accurately as possible. However, if errors or omissions have occurred regarding this presentation, the seller's liability cannot be engaged. Product photographs are not contractual.
Article 9 — Prices
The seller reserves the right to modify prices at any time but undertakes to apply the rates in force at the time of the order. Prices are quoted in euros. They do not include delivery charges, which are charged separately and indicated before order validation. Prices include VAT applicable on the day of the order.
Article 10 — Payment Methods
This is an order with payment obligation. Accepted payment methods: • Credit/debit card • PayPal The seller reserves the right to suspend any order management in case of payment refusal.
Article 11 — Product Availability
Delivery times for mainland France: 2 days from the day following the order, by email or from the website. Maximum: 30 working days after conclusion of contract. If the product is unavailable, the buyer will be informed as soon as possible and may cancel their order and receive a full refund within 14 days.
Article 12 — Delivery Terms
Products are delivered to the address provided by the buyer. Any parcel returned due to an incorrect or incomplete address will be re-dispatched at the buyer's expense.
Article 13 — Delivery Errors
Any complaint about a delivery error must be made on the day of delivery or at the latest the first working day following delivery, by email to: contact@ofcoursetrader.com Any complaint not made within these rules and deadlines cannot be taken into account.
Article 14 — Product Guarantee
14-1 Legal guarantee of conformity The seller guarantees the conformity of the goods sold. The buyer has 2 years from delivery to take action. The buyer may choose between repair or replacement of the goods. 14-2 Legal guarantee of hidden defects The seller guarantees against hidden defects. This guarantee must be implemented within 2 years of the discovery of the defect. The buyer may choose between cancellation of the sale or a reduction in price.
Article 15 — Right of Withdrawal
The buyer has 14 days from the delivery date to return any item and request an exchange or refund without penalty, except for return costs. Exceptions (Article L221-28 of the Consumer Code) — The right of withdrawal cannot be exercised for: • digital content not provided on a physical medium whose execution has begun after the consumer's express prior agreement • personalised or custom-made goods • audio/video recordings or computer software unsealed after delivery
Articles 16–25 — Force Majeure, IP, GDPR, Applicable Law
Force majeure: Circumstances beyond the parties' control that prevent normal performance of obligations constitute grounds for exemption from obligations. Intellectual property: All technical documents, products, photographs, texts, logos, drawings, videos, etc. are subject to copyright and protected by French intellectual property law. GDPR: Personal data collected is used only to execute the contract and for commercial follow-up.
